Agreement to these terms

These terms of service (“terms”) are a binding agreement between you and Trees and Rain LLC (“we”, “us” or “our”). They cover the PapiDNS app, the website at www.papidns.app, and the related services we provide (together, “PapiDNS”).

By creating an account or using PapiDNS, you agree to these terms. If you don’t agree, don’t use PapiDNS. If you use PapiDNS for a business or other organization, you agree to these terms for it and confirm you have authority to do so.

Your license to use PapiDNS

As long as you follow these terms, we give you a limited, non-exclusive, non-transferable and revocable license to install and use the PapiDNS app on devices you own or control, for your personal use or your internal business use. Your use must also follow the rules of the App Store.

PapiDNS itself, including its software, design, text, graphics, name and logo, belongs to Trees and Rain LLC and our licensors. These terms don’t give you any other rights in it.

Who can use PapiDNS

• You must be at least 13 years old to use PapiDNS. PapiDNS is not directed to children under 13.
• If you are under 18 (or under the age of majority where you live), you may use PapiDNS only with the permission of a parent or legal guardian. That parent or guardian agrees to these terms for you and is responsible for how you use PapiDNS, including any purchases.
• You can’t use PapiDNS if we have previously closed your account for breaking these terms, or if the law prohibits you from using it.

Your account

You sign in to PapiDNS with Apple or Google. We don’t offer sign-in with an email and password, and we never see the password for your Apple or Google account.

• Keep it secure. Keep your devices and your Apple or Google account secure, for example with a device passcode and two-factor authentication. You are responsible for what happens under your PapiDNS account. If you think someone has used it without your permission, tell us right away through our contact form.
• Losing access. If you lose access to the Apple or Google account you use for PapiDNS, you may lose access to PapiDNS too. Contact us and we’ll try to help, but we can’t promise to restore access.

What PapiDNS is and isn’t

PapiDNS is an independent app that uses GoDaddy’s public API to show and change the DNS records of domains your GoDaddy API key can reach, and to change a domain’s nameservers. In particular:

• PapiDNS isn’t made, endorsed or supported by GoDaddy, and we aren’t a GoDaddy reseller or partner. Your domains, your DNS hosting and your GoDaddy account are governed by your own agreement with GoDaddy.
• We don’t host your DNS, register domains or run name servers. PapiDNS sends the changes you make to GoDaddy directly from your device.
• PapiDNS works only if GoDaddy gives your account API access and the API is available. GoDaddy decides who can use its API and may limit, change or stop it at any time.
• PapiDNS isn’t a backup service. Keep your own record of important DNS settings.

Your DNS changes

DNS controls where your website, email and other services point. A wrong change can take them offline, stop email from arriving, or break security checks such as certificate validation.

• Changes are live. When you save an edited record set, PapiDNS sends it to GoDaddy right away, and it replaces every record of that type and name. Adding a record set keeps the existing records. Changing a domain’s nameservers moves its whole DNS to another provider.
• Check before you save. You are responsible for the changes you make with PapiDNS, including their effect on your domains, websites, email and anyone who relies on them. Only change domains you’re authorized to manage.
• Propagation. DNS changes can take time to reach everyone, depending on TTLs and caching outside our control.
• Other protections. GoDaddy settings such as Domain Protection or two-step verification can block changes made through the API. That’s GoDaddy’s choice, not a fault in PapiDNS.

Your API keys and passphrase

• You control the keys. You create your GoDaddy API keys in your own GoDaddy account, and you can revoke them there at any time. Only add keys you’re allowed to use.
• We can’t recover your passphrase. Your keys are encrypted on your device with a passphrase we never receive. If you lose your passphrase and don’t have a recovery code, we can’t unlock or recover your key; you’ll need to delete it and add it again.
• Keep them safe. Keep your passphrase and any recovery code secret. Anyone who has a recovery code can unlock that key. Don’t send us your API key, secret, passphrase or recovery code, including in support messages or screenshots; we’ll never ask for them.
• Remembered keys. If you choose “Remember on this device”, anyone who can unlock your device can use that key in PapiDNS. Use it only on devices you control.

Premium subscriptions

PapiDNS is free to download and to use for viewing your domains and records. PapiDNS Premium is an optional subscription. It currently adds creating, editing and deleting records, changing nameservers, and sending bug reports and feature requests from the app. We may add or change Premium features over time (see changes).

We don’t list prices here because they vary by country. The current price is always shown in the app and in the App Store before you buy.

• Premium is an auto-renewing subscription, offered monthly or yearly. It is sold through the Apple App Store, and Apple processes your payment. We never see your card details.
• Payment is charged to your Apple Account when you confirm the purchase.
• Your subscription renews automatically for the same period, and your Apple Account is charged for the renewal at the price shown in the App Store at that time, unless you cancel at least 24 hours before the end of the current period. The renewal is charged within the 24 hours before the current period ends.
• If the price of Premium changes, Apple will tell you before the new price applies, and ask for your agreement where its rules require it.
• If we offer a free trial or introductory price, its terms are shown before you subscribe. If you buy a subscription during a free trial, any unused part of the trial ends when the subscription starts.
• You can manage or cancel your subscription at any time: on an iPhone or iPad, open the Settings app, tap your name, then tap Subscriptions. When you cancel, you keep Premium until the end of the period you have already paid for.
• Refunds are handled only by Apple under its policies, so please ask Apple.

Acceptable use

When you use PapiDNS, you must not:

• Use it to change DNS for domains you aren’t authorized to manage, or with API keys you aren’t allowed to use.
• Use it to hijack domains, redirect traffic without permission, or support phishing, malware, spam or fraud.
• Access, or try to access, data or accounts that aren’t yours, even if a technical flaw makes it possible.
• Reverse engineer, decompile or disassemble the app, except where the law expressly allows it.
• Get around subscription checks or any security or access control, or give yourself Premium features without paying for them.
• Interfere with or disrupt PapiDNS, overload our servers, probe them for security weaknesses, or upload malware. If you find a security problem, please report it through our contact form instead.
• Use PapiDNS in a way that breaks GoDaddy’s terms or API rules, such as exceeding its rate limits on purpose.
• Send false requests through our website forms, including deletion requests for accounts that aren’t yours.
• Use PapiDNS for anything illegal, or to violate anyone else’s rights.

Bug reports and feedback

When you send a bug report, feature request or other feedback, you give us permission to store it and use it to fix and improve PapiDNS, without any obligation to you. Don’t include anything you don’t have the right to share, and don’t include secrets such as API keys. A screenshot shows whatever was on your screen, so choose it with care.

GoDaddy and other services

PapiDNS works with services we don’t control. Their own terms and privacy policies apply when you use them, and we aren’t responsible for their availability, content or practices. These include:

• GoDaddy, which hosts your domains and DNS and provides the API PapiDNS uses.
• Sign-in: Sign in with Apple and Sign in with Google.
• Payments: the Apple App Store.
• Lookups: Google Public DNS and rdap.org, which the app uses to check where a domain’s DNS is hosted.

No affiliation, and trademarks

PapiDNS is an independent app. It is not affiliated with, endorsed by or sponsored by GoDaddy. GoDaddy® is a registered trademark of GoDaddy Operating Company, LLC. Apple, App Store, iPhone, iPad, Google and other names are trademarks of their owners. We use them only to identify their products and services.

Privacy

Our privacy policy explains what information we collect, how we protect your API keys, how long we keep information, and the choices you have.

Deleting your account and termination

You can leave at any time

You can stop using PapiDNS whenever you like. To delete your account in the app, tap the menu button at the top right of the home screen, then Delete Account. You can also ask us to delete your account or some of your data on our data deletion page. Deletion is permanent. It doesn’t change anything at GoDaddy. Our privacy policy explains what is deleted and what we keep for a limited time.

We can suspend or close accounts

We may suspend or close your account if you break these terms, if your use puts other people or PapiDNS at risk, or if the law requires it. Where it is reasonable, we will tell you why, unless doing so would put someone at risk or break the law. If you think we made a mistake, tell us through our contact form.

If your account is closed for breaking these terms, you aren’t entitled to a refund, except where the law or Apple’s refund policy requires one.

The sections of these terms that by their nature should continue after your account ends will continue. These include the disclaimers, the limitation of liability, indemnification, disputes and the general terms.

Disclaimers

PAPIDNS IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, TREES AND RAIN LLC DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT PAPIDNS WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, THAT IT WILL WORK WITH GODADDY OR ANY OTHER SERVICE, OR THAT YOUR DATA WILL NOT BE LOST.

YOU ARE RESPONSIBLE FOR THE DNS CHANGES YOU MAKE. WE MAKE NO WARRANTY ABOUT THE RESULT OF ANY CHANGE, ABOUT GODADDY’S SERVICES, OR ABOUT THE AVAILABILITY OF YOUR DOMAINS, WEBSITES OR EMAIL.

Some places don’t allow implied warranties to be excluded, so some of these disclaimers may not apply to you. Nothing in these terms limits any rights you have under consumer protection law that can’t be waived.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TREES AND RAIN LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AGENTS, SUPPLIERS AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, BUSINESS OR GOODWILL, ARISING OUT OF OR RELATING TO PAPIDNS OR THESE TERMS. THIS INCLUDES DAMAGES FROM DOWNTIME OF YOUR DOMAINS, WEBSITES OR EMAIL, FROM DNS CHANGES, FROM A LOST PASSPHRASE OR RECOVERY CODE, AND FROM ANY THIRD-PARTY SERVICE. IT APPLIES WHETHER THE CLAIM IS BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN TOLD THAT SUCH DAMAGES ARE POSSIBLE.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO PAPIDNS OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID FOR PREMIUM IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US$50.

Some places don’t allow these exclusions or limits, so they may not fully apply to you. Nothing in these terms excludes or limits our liability for fraud, gross negligence, willful misconduct, death or personal injury caused by our negligence, or any other liability that the law doesn’t allow us to exclude or limit.

Indemnification

To the extent the law allows, you agree to defend, indemnify and hold harmless Trees and Rain LLC and its members, managers, employees, contractors and agents from any claims, losses, liabilities, damages, costs and expenses (including reasonable attorneys’ fees) arising out of:

• your use of PapiDNS, including DNS changes you make with it;
• domains or API keys you use with PapiDNS without authorization; or
• your breaking these terms, the law or anyone else’s rights.

We may take control of the defense of any such claim, and you agree to cooperate with us. This section doesn’t apply to the extent a claim was caused by our own wrongdoing.

Governing law and disputes

Talk to us first

Most problems can be sorted out quickly. Before you bring a claim against us, please send us a message through our contact form with your name, the email address on your PapiDNS account, a description of the problem and what you would like us to do. We will do the same before bringing a claim against you. Both of us agree to try in good faith to resolve the issue informally for 30 days after the message is received. If it isn’t resolved in that time, either of us may take it further.

Governing law and courts

These terms are governed by the laws of the State of Washington and by applicable U.S. federal law, without regard to conflict-of-law rules. Apart from small claims, disputes will be heard in the state or federal courts located in Washington, unless the law where you live gives you the right to bring the claim in your local courts.

Small claims

Either of us may bring an individual claim in a small claims court if the claim qualifies.

If you live outside the United States

If you are a consumer, you keep the protection of any mandatory laws of the country where you live, and you may bring a claim in the courts there if those laws allow it.

Additional terms for the Apple App Store

If you downloaded PapiDNS from Apple’s App Store, these terms also apply:

• Who the agreement is with. These terms are between you and Trees and Rain LLC only, not Apple. Trees and Rain LLC, not Apple, is solely responsible for PapiDNS and its content.
• Scope of license. Your license to use PapiDNS is non-transferable and lets you use it on Apple-branded products that you own or control, as permitted by the Usage Rules in Apple’s Media Services Terms and Conditions. PapiDNS may also be used by other accounts linked to yours through Family Sharing or volume purchasing.
• Apple’s standard license. Unless the App Store shows a separate license agreement for PapiDNS, Apple’s Licensed Application End User License Agreement also applies to your copy of PapiDNS from the App Store, together with these terms.
• Maintenance and support. Trees and Rain LLC is solely responsible for providing any maintenance and support for PapiDNS, as described in these terms or as the law requires. Apple has no obligation to provide any maintenance or support for PapiDNS.
• Warranty. Trees and Rain LLC, not Apple, is solely responsible for any product warranties, whether express or implied by law, to the extent they are not effectively disclaimed. If PapiDNS fails to meet any warranty that applies to it, you may notify Apple, and Apple will refund the purchase price you paid for the app, if any. To the fullest extent permitted by law, Apple has no other warranty obligation for PapiDNS. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to meet a warranty are Trees and Rain LLC’s responsibility, subject to these terms.
• Product claims. Trees and Rain LLC, not Apple, is responsible for addressing any claims by you or anyone else relating to PapiDNS or your possession or use of it. This includes product liability claims, claims that PapiDNS fails to meet any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
• Intellectual property. If anyone claims that PapiDNS, or your possession or use of it, infringes their intellectual property rights, Trees and Rain LLC, not Apple, is solely responsible for investigating, defending, settling and discharging that claim.
• Legal compliance. You confirm that you are not located in a country that is subject to a U.S. Government embargo or that the U.S. Government has designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Questions and claims. Send any questions, complaints or claims about PapiDNS to Trees and Rain LLC through our contact form at www.papidns.app/support/.
• Third-party terms. When you use PapiDNS, you must follow any third-party agreements that apply to you, such as your agreement with GoDaddy and your mobile data plan.
• Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept these terms, Apple has the right (and is deemed to have accepted the right) to enforce them against you as a third-party beneficiary.

If anything in this section conflicts with the rest of these terms, this section controls for the copy of PapiDNS you downloaded from the App Store.

Changes to these terms and to PapiDNS

Changes to these terms

We may update these terms from time to time, for example when PapiDNS changes or when the law or App Store rules change. When we do, we will change the “Last updated” date at the top of this page. If a change is material, we will also let you know in the app or by email before it takes effect.

If you keep using PapiDNS after changes take effect, you accept the updated terms. If you don’t agree with them, stop using PapiDNS and delete your account.

Changes to PapiDNS

We may add, change or remove features, change what Premium includes, or stop offering PapiDNS. If a change significantly reduces what Premium includes, or if we stop offering PapiDNS, we will try to tell you in advance so you can cancel your subscription.

General terms

• Entire agreement. These terms, together with our privacy policy, are the entire agreement between you and Trees and Rain LLC about PapiDNS. They replace any earlier versions and any earlier agreements about PapiDNS.
• Severability. If any part of these terms is found to be unenforceable, it will be enforced to the extent possible, and the rest of the terms stay in effect.
• No waiver. If we don’t enforce a part of these terms, that doesn’t mean we give up the right to enforce it later.
• Assignment. You may not transfer your rights or obligations under these terms without our written consent. We may transfer ours as part of a merger, acquisition, reorganization or sale of assets, or by operation of law.
• Force majeure. We aren’t responsible for delays or failures caused by events beyond our reasonable control, such as natural disasters, outages at GoDaddy or our service providers, internet or power failures, cyberattacks, labor disputes or government action.
• Time to bring claims. To the extent the law allows, any claim relating to PapiDNS must be brought within one year after it arises.
• No other beneficiaries. Apart from Apple and its subsidiaries as described above, no one other than you and Trees and Rain LLC has any rights under these terms.
• Relationship. These terms don’t create any partnership, joint venture, employment or agency relationship between you and us.
• Notices. We may send you notices in the app or by email to the address on your PapiDNS account. You can send notices to us through our contact form.
